The Presidential Election Petition Court this afternoon threw out Peter Obi and Abubakar Atiku's petitions against President Bola Ahmed Tinubu.
Obi and Atiku were Labour Party, LP and People's Democratic Party candidates respectively in the February 25, 2023 presidential election.
In its ruling, the Court rejected and dismissed their petitions for lack of substantial evidences and outright falsehood.
Meanwhile, the Labour Party candidate, Mr. Peter Obi has rejected the judgement considering it as justice denied. He has vowed to seek redress at the Supreme Court.
Below are some of the take aways from the judgement.
1). *DRUGS AND $46,000 ALLEGATIONS AGAINST TINUBU*.
On the alleged drug case and forfeiture of $46,000 against Tinubu, the Court said forfeiture doesn't mean automatically that Tinubu was indicted. Moreso, it was not Tinubu who directly forfeited the money, but an organization where Tinubu allegedly has interest. In addition, Tinubu was never charged with criminal case in the USA. To crown it all, the judgement in the USA was not reported to Nigeria, and thus not known officially to Nigeria law. Therefore, it cannot disqualify Tinubu from contesting or capable of nullifying the outcome of the election. It has no direct bearing with the conduct of the presidential election.
2). *PETET OBI'S CHICAGO UNIVERSITY ALLEGATIONS*
The Court dismissed Abubakar Atiku and Peter Obi's Chicago State University and certificate allegations against Tinubu. The Court said the petitioners (Peter Obi and Atiku Abubakar) failed to prove their allegations beyond reasonable doubt. Moreover, the University had earlier written on the issue to confirm that Tinubu actually attended the school.
3). *NON-ELECTRONIC TRANSMISSION OF PRESIDENTIAL ELECTION RESULTS.*
The case of non- electronic transmission of Presidential election results real time against INEC, meant to nullify Tinubu's election was thrown out. The Court ruled that it is not compulsory because Nigeria constitution does not mandate INEC that election results must be transmitted electronically: So long as the method of transmission conforms substantially with constitutional provisions. INEC complied with the use of BVAS and the polling unit results were given to the various party polling agents at every polling unit across the country. They also signed after receiving the results. The Court said these are enough. Therefore, INEC cannot be forced to announce election results electronically.
4). *PETER OBI'S ALLEGATION THAT HE WON IN MORE STATES BUT INEC ROBBED HIM AND GAVE HIS VOTES TO TINUBU*
On Peter Obi's allegation that he won in Ogun, Oyo Ekiti, Zamfara Benue and several other states but INEC robbed him of his votes and gave them to Tinubu, the Court ruled that Peter Obi succeeded in providing very scanty evidences in a few pulling units to support his allegation. The Court said that the evidences provided were not substantial to alter the total result and tilt the presidential election in his favour. The Court therefore dismissed the allegation.
5). *PETER OBI'S ALLEGATION OF BLURRED BALLOT PAPERS TO FAVOUR TINUBU*
Court ruled that Peter Obi's allegation that 18,888 ballot papers were blurred to favour Tinubu was unfounded.(Lies). The allegation was subsequently thrown out.
6). *COURT STRUCK OUT 1O OF PETER OBI'S 13 WITNESSES*
The Court struck out 10 out of 13 witnesses presented by Peter Obi and Labour Party.
7). *PETER OBI'S ALLEGATION OF OVER VOTING IN A PLACE LIKE RIVERS STATE THROWN OUT*
Peter Obi's allegation of over voting against INEC and Tinubu was rejected because he could not provide BVAS machines and voters registers to prove that there were actually over voting in the number of pulling units he alleged.
8). *ON TINUBU NOT WINNING 25 PERCENT VOTES IN ABUJA*
The Court ruled that it is not compulsory that va presidential candidate must win 25 percent before he could be declared winner of a presidential election because Abuja should be taken like a state treated as such. This, it is neither superior nor inferior to any other state.
9). *VP KASHIM SHETTIMA'S ALLEGED DOUBLE NOMINATION*
The attempt to nullify Tinubu's election through the allegation that his Vice, Kashim Shettima was already a Senatorial Candidate in Borno State before Tinubu picked him as his running mate was rejected by the court because there is evidence to prove that Shettima had duly withdrawn from the Senatorial race before he was chosen as the Vice-Presidential candidate of All Progressives Congress, APC.
